Question

How would you approach your district autism specialist who admitted to lying on your sons school application and registered your son as a first grader so that he could obtain all day school services in a Transition Program for children with autism. Our son was supposed to be registered as a kindergarten student at our school but we requested that he attend all day kindergarten. We offered to pay the extended day fee for all day kindergarten. Instead of being honest with us, our district autism representative enrolled my son as a 1st grader at school but never told us. We found out this information in March and fought the school district that he was supposed to be a kindergarten student. The district forced him to go from 1st grade to 2nd grade. My husband and I finally found the paper trail that lead to the truth, the lies exposed. However, the school than kicked us out of their autism transition program stating he is now "repeating" 2nd grade. Falsifying a record? Help!

We found the paper trail that lead to the truth. After our district autism rep. sat in meeting after meeting while my husband and I plead our case, she never said one word of the truth. When we found the paper trail and got written testimonies from people who knew our son was supposed to be in kindergarten she confessed to my husband, myself, infront of a few other people that she had lied on his application. We had those witnesses sign statements of her confession. We want the services from the transition program that my son deserves. Our principal refuses to listen or help. Our son desparately needs the help of the Transition Program trained autism personnel to assist him in the classroom. He is as entitled to that program as the other students who are now in 2nd grade and started out in his kindergarten program.

Hello Need Trust: You do not approach this woman again at all. If you have a paper trail and statements from witnesses that she lied about this matter in order to shuffle your child into 1st grade when he should not have been there, then you need to take the matter up with the Oregon state Department of Education. The website is: http://www.ode.state.or.us/. Write a letter of complaint and send it certified mail, return receipt requested to the director of public education in Oregon (you should telephone them and get the name of the appropriate person to send your complaint --- there could be a special director for autism). Try to be detailed but brief (I know that is hard, but the attention span of public officials is usually not longer than a page or two). Set forth your issues and enclose copies of the statement of the witnesses who heard this woman admit to her lies. Tell the Board that you need some help in straightening this matter out immediately, even if it simply as a facilitator and mediator between you and the local school district. Send a copy of the letter and all statements to the Superintendent of Schools for your sons school (the person who runs the schools in your district). Also state that you are contemplating legal action in this matter so that you son will get the special needs services he is entitled to under both state and federal laws. Then,wait to see if there is a response -- hopefully this will be enough to get the school to listen to you and put your son in the appropriate programs. If not, and they ignore your requests or tell you that there is nothing that can be done, then you should seek out a lawyer in your area who is familiar with educational issues. Your state bar association should be able togive you a referral to a lawyer in your area who handles these cases. Typically, a first consultation is free, so you should bring as much information with you to that first appointment as you possible can so that the lawyer can give you a good assessment of the merits of any case you might be able to bring against them.
