Question

I havce been fighting a suit brought on be an attorney for a collection agency for two years. I was awarded judgement and the attorney was ordered to pay my attorney fees. (He was also found in contempt of court by the presiding judge.) he appealed the judgement to the Supreme Court. We were assigned a settlement judge to resolve the situation without going to court. After 3 hours of negotiating the attorney agreed to pay a reduction in attorney fees. One payment was due Oct 15 to two attorneys and the other payment is dure Nov. 8. Neither attorney has received the first payment. This is the second time this attorney has ignored court orders. What can I do now. Can I file a complaint against the attorney suing me, the one who is ignoring all court orders the latest being a stipulaltion which was made a part of a Supreme Court Appeal. What can I do to get my attorneys paid without having to be billed more hours.

You should first alert the court clerk that the attorney has failed to comply with the court's order. Next, you should report the attorney to the Nevada Bar: http://www.nvbar.org/ethics/file_a_complaint.htm

What I need to know is do I have a just cause to file a complaint?

Accepted Answer

Yes, but it is technically not a Complaint, since the matter is already before the court. You can file a motion for sanctions against the attorney for repeated failure to comply with the court order. The attorney is now in contempt of a court order and subject to additional financial penalities and jail time.
