Question

my nom signed over her house to my sister in 2005 my mom is now ill and going in a rest home also my sister lived with and is also going in a rest home. my sister is going to sell house does she have to split money from sale of house with me and my brother. my mom has dementia .

When you say that she "signed over the house", what do you mean? Was there a quit claim deed made?

 

Do you know if you and your brother were put on the deed?

from what i know she signed it over in oct 04 and my sister put it her name only on the deed in 05. no i was not on the deed or my brother

I am sorry for your mother and the situation in which you now find yourself.

 

If your mother actually signed over the house to you sister by giving your sister 100% interest in the home, then your sister can do what she pleases with the home. That means that your mother literally gave your sister the house. She does NOT have to split the proceeds from the sale of the home with you and your brother.

 

If your mother signed a quit claim deed giving your sister a "right to survivorship", that means that upon your mother's death, your sister becomes the owner of the home. Again, she can do what she pleases with the home and does NOT have to share the proceeds with you and your brother.
