Question

My sister and I inherited a house, father passed, house has been thru probate, we are both half owners. I started fixing up the house, she decided to move in it. She has done nothing to improve it and she hasn't paid her half of taxes or funeral for 3 years. I told her if she was going to stay there I wanted rent, just so she would not stay there for ever, she paid once. I tried to buy her out she wanted $80,000, first I cannot afford it, second it ain't worth it, third I can't get a second homestead. I told her I would try and help her get a mortgage, said her credit would not help, I told her I would hold a note and pay me no interest till paid off, said she doesn't want the house. She kept saying she was calling ugly houses and gonna sell, did not happen, I called and was given an offer, $130,000, ithink been a couple years, next thing after she called him, he doesn't even want to talk to me no more. have pre paid legal, taking too long

Yes and collect the money she owes

Accepted Answer

ok, to get your sister out of the house you would have to petition the court for a forced sale of the property since you and your sister cannot agree on what to do with the home.

Regarding the money, technically as an owner of the home she does not owe money for rent, and the disparity in money paid for taxes and maintenance would be addressed in the dissolution with you being entited to repayment for half of the taxes paid.
