Question

A roofing company structurally damaged our house by not properly loading replacement shingles on our roof. We are afraid that the roof will completely collapse under the load of snow this winter. The roofing company has not compensated for the damage, which occurred three months ago. The damage is about $25,000.

Already Tried:
Talked with the owner of the roofing company. He claims that the damage was done by the suppliers of the building materials. But the damage was done under his supervision, he contracted the supplier and his people were present when the damage occurred.

What do I need to do to force the roofer to compensate for the damage? What are the legal steps?

Accepted Answer

Ok, since you are talking about 25K in damages, you would have to file suit in District court since small claims are capped at 7500 and County is capped at 15K. You would be suing the roofing company since the supply company would be considered a subcontractor for materials and was acting under their direction in the placement of the shingles.

 

I would retain an attorney and filing suit for breach of contract for your damages, attorney's fees, court costs and fees.
