Question

I have a harrasment action pending agaisnt me due to a written note and text that were considered threatning to my girlfriend. They general verbaige was non-theatning... nbut i used the word bitch... and made one statement about wishing her to go to hell due to her actions. I didn't thing anything of it, but she is full revenge mode and pushed for an arrest beacuse i broke objects that we shared (but i paid for)... yes, high school type bs... i have court this week in weld county Colorado... what is my best course of action. I'm currently gathering refernces to my charcater showing I'm calm, rational, harmless, active in the community etc... what reccomendations do you have... and what should i expect?

Hi Barryamold: Break ups can be rough, I know all too well . The thing is, as you are facing potential criminal liability, I would get a lawyer -- and fast. You do not want to fall into rookie traps trying to defend yourself when there could be jail time. If you can't afford one, the court will appoint one. Someone who knows the law really needs to look over the facts and circumstances (and any documents) to analyze them and develop a defense strategy. Just because you called her names or broke your own property does not neccessarily a criminal charge support. There may be plus factors that support it, but don't assume that just because you were charged and were intermperate that you committed crimes. Words, in and of themselves, unless direct threats, may be protected speech -- even if they are ugly. Context is everything and you really need someone who is wholly on your side putting this in context under the law.
