Question

i have a lawyer for a workmans comp case and he doesn't seem to know what he is doing we are close to 5 years now and I feeel like he is giving me a spin. He has never contacted any of my witnesses and its a discrimination case. I worked for the State of Mich. for 26 years and always had good work history until I got this one boss. Can you sue your own lawyer. He only says he can get 50,00 and medicare and medicaid has a lien against more than that. why isn't Mch.liable for that? don't they have "deep pockets"?

Optional Information

State/Country relating to Question: Michigan

Already Tried:
complaining to lawyer and he yells when I question him.

Accepted Answer

Thank you for contacting our JA team for guidance.

It sounds like you need to consult with a different worker's comp attorney. Your attorney should not be yelling at you for questioning him. Yes. You can sue your attorney if there is professional malpractice involved, but you would need an opinion as to whether you would have a case of malpractice from another attorney. They would need to review your case file and provide an opinion.

You can also contact the MI bar association and file a formal complaint against your attorney. The bar association can provide you with attorney referrals as well. I would contact the bar as a first step in getting this matter resolved in your favor.

Please let me know if you need additional information.

Best regards to you,

TG
