Question

My neighbor built his home on the lot next door close to 2 years ago. When he built the home he had a privacy fence built. We had no fence at the time. We recently bought a puppy and decided we needed a fence. When the workers were setting the posts for our new fence, my neighbor told the workers not to tie in to his fence and he later informed me that I should split the cost of the shared side of his preexisting fence and split the cost of repairs needed to the fence due to Hurricane Ike damage over a year ago. Do I owe him anything?

Hello XXXXXXXXX,

Welcome to Just Answer.

Sorry to hear about your problem.

You owe your neighbor absolutely nothing. It his his fence, he owns it and any repair/ maintenance is his responsibility. It should be installed on his side of the property line and not on yours. He is correct in that you cannot attach anything to it without his permission.
