Question
While attending college at Kent, my son was cited last year in Ohio for underage drinking. He entered into the diversion program and had his record expunged. He is a PA resident and no longer attends school in Ohio. This past weekend he went to visit a friend. They went to get on an elevator in his friend's dorm and another friend had a beer in his hand. My son had just arrived in Kent, but the police were called and he was cited for possession. The person he was visiting had beer in his refrigerator. Help, I don't know what to do next about this?

Hi Mom. This is just awful! Especially if he was unaware or just happened to be in the wrong elevator at the wrong time.
I really do think you'll need to hire a lawyer to help with this. There are evidence issues here involving what he knew, and who paid for the beer, etc. If you can't afford a lawyer, let me know and I can send you links to free legal services in the Kent, Ohio area.

Any referrals in Kent would be greatly appreciated. Part of the problem was that the kid holding the beer lied to the RA about his status--showed a military ID because he had just enlisted the day before. Because he lied, the police were called and all three boys were retained. My son claims he told the policeman he had a beer--was afraid not to because of the way everyone was acting. He had hardly been there any time at all, but I can't guarantee he didn't have the beer. The beer was in his friend's refrigerator and his friend was also charged with possession. UGGH!!!!!!!

I'd call the number listed on the web page, and ask for the trial litigation clinic. Then speak to the supervisor there about "intake." If they can't help, they can probably refer your son to someone who can.
