Question

My husband signed a contract with a realtor to sell our home and signed my name as well. We own the home in joint tenency. Is this contract valid?

I was out of town when the contract was signed. The contract says : Said commission shall be paid to Broker if the Property is sold during the term of this Agreement, regardless of whether the sale is made by broker, by Owner, or by any other broker or agent, or bgy any other person or any other means. However, Owner has the right to list on this Agreement any parties to whom Owner reserves the right to sell, and if a sale to any such parties occurs within fourteen after the date thereof, Owner is not obligated to pay a commission to Broker. 3. Owner shall also pay said commission to Broker if:a) within ten days after expiration of this Agreement Broker provides in writing to Owner the names of prospective buyers who were shown or offered the Property during the terms of this Agreement and b) Owner sells the Property to any such prospective buyers within six (6) months after expiration hereof by or through an HHMLS Broker who has a then current, valid listing agreemnt with Owner.

Accepted Answer

The sale of the home requires he consent of both sides. Here you can seek to rescind the contract if realtor wont agree on the basis of fraud. You should have a lawyer involved since buyer can either argue that you either signed, consented to him putting your name, or that he had authority to do so.
