Question concerning MC11 - Subpoena, Order to Appear and/or Produce. I notice you have asked a couple questions on this site, but have yet to accept an answer. Before I become involved with answering your current question, is there some reason that you have not been satisfied with these previous answers, and is there a way to insure you are satisfied with my assistance? If a customer does not accept an expert's answer, then the expert receives nothing for their time. So you can understand why we end up not wanting to get involved with non-paying customers. I will await your reply. Thanks.

Previous questions were related to auto repairs, responders never answered original question, so I never paid. I have no problem paying when a question is answered.

Okay, thank you. I just did not want you to be flagged as a non-paying customer. To answer your questions:

 

Is a signature required to be valid/enforceable?

 

It should be signed, but if it's not, a Bar number will suffice. It is not invalid though.

 

If a Bar # is included, is the attorney specified by Bar# required to sign?, or can someone else sign and still list Bar#?

 

Someone else can sign on behalf of the attorney, as long as the attorney's Bar # is listed.

 

Can documents acquired by defective/improper Subpoena be excluded from evidence in a trial before District Court Judge, no jury trial?

 

If you have an objection to a document you were served because it is defective, then you should file a "Response in Opposition to Subpoena" and list your objections. They other side will have an opportunity to correct the Subpoena, and if they do not, a hearing can be set on the matter. There, the judge will rule on your objections to the Subpoena.

 

Is my best option to file motion to exclude exhibits due to fraud?

 

If you want to exclude exhibits for that reason, you should file a "Motion to Strike Exhibits" and then list which ones you want stricken and why. Fraud is a valid reason for having them thrown out.
