Question

I had a problem with a house that i was renting.I consulted an attorney and did what he told me to do. He said that he could represent me in court on this issue since I was moving out of state and that I had a good case. I asked how much it would cost me and he quoted me a price. They went to court and the landlord dropped the case, then refiled it. They prepared to go to court again, but our witness couldn't be there so we asked for a continuance (no mention of further costs at this point or any bills). We've had several other continuances, so many that all of my witnesses have left. They sent me a letter saying that if we wanted to continue, we had to do a deposition. since it wasn't part of the original deal, it would cast an additional $300. I said okay. I've now received another letter stating that since the case was refiled, it would cost an additional $750 for them to continue representing me. Can they do that at this point?

Absent a written agreement with the attorney this would be something you would have to take up in fee dispute arbitration, but for this point and time the attorney can demand more money to continue representation and if you do not pay they can withdraw from the case. You are in one of those situations where you are backed into a corner. What you could also do, which would cause him to likely withdraw as well, is file a complaint with the state bar office of disciplinary counsel for his failure to provide a written representation agreement and fee agreement.
