Question

In April 2009 I submitted a joint tax return for my wife and me, no problem. My 16 year old daughter had worked the previous year part time and had earned less than the maximum amount before tax returns are required. I didn't realize at the time that she was getting tax deducted by her employer before receiving her net pay. It is now near the end of October, is there a way for her to recover the taxes she has paid?

Thanks for your question.

If your daughter had withholding on her paycheck in 2008, she will just need to file a return - Form 1040EZ with the Form W-2 in order to get her withholding tax refunded. If you claimed her as a dependent in 2008, be sure to check the box on the form where it asks if you can claimed another person's return. If no tax is due, there will be no penalties/interest. It is past the time for e-fling 2008 returns, so you would have to send in a paper return. See 2008 Form 1040EZ

For 2009, she can file her return when you get her W-2 near the end of January 2010 in order to claim he withholding tax credit.

The same instructions would aplpy if the state withheld taxes - you would have to file Michigan state income tax returns for her to get her money back.
