Question

I have a 19 year old daughter, I have been divorced from her father for 11 years. He has never paid any child support. I filed for support at the time of divorce in LA. I moved to GA shortly after and I been in GA and remarried sense. The Division of Child support in GA was no help, was told I would have to refile in GA after years of the run around. My question is can my daughter get support (back support) now that she is in college. Thanks

Answer

No, you would be receiving the back support and not the daughter. She is not entitled to the support herself since you were her legal guardian at the time.

However you can also petition for modification and request that your ex attempt to help with her college expenses also. That would also go to you, but it can assist you with paying her fees for her college education.

The state of LA never sit a dollar amount, the paper was incomplete. What should I do? Let it go?

Answer

You should not let it go. If you can find the original income statements of the ex, you may be able to take it to a family law attorney and calculate the backpay owed solely from those statements. It is not definitive, but you may be able to file that way, since a decree already existed but was incomplete.
