Question

I signed onto a parcel owing 0ver $13000 that my sister wanted out of having to pay. Her and her husband signed Quit claim Deeds.I took over the taxes and payed it off. Now her quit claim Deed has been misplaced and she want sign another. A couple years ago she filed Bankruptcy and claimed she had no property.I live in Arkansas what should I do now?

Yes I am trying to sell the property.The title company handeling the sale said there was none filed.But if that were so why was it changed to my name on the tax role.

Answer

You cannot transfer something you do not have. The fact it was not recorded does not mean it cannot be recorded now. If she lost it, the title company should assist her in filing a new one.

The problem is she refuses to sign the quit claim deed now

You need to try to obtain a copy. A lawyer may have a copy. The bank may have a copy. The court may have misplaced it. It needs to be located to prove the transfer. Kindly accept my answer.
