Question

I live in California & work at a nuclear power plant. A female coworker is/was involved with a male in the same department. He sent her video of himself masturbating in a private but shared work area (an area where other workers rotate into). This same male also sent disturbing text messages (sexual harassment) to another woman who I believe is homosexual. It appears that these text messages could also be construed as a hate crime. This woman felt the male coworker was stalking her. She tried to handle the situation herself, but the harassment continued. A third female found out about the video & the text messages &reported the problem to management. The male worker was escorted off the power plant. Here's the problem: it seems possible the company might allow the male to return to work. If the other females don't file a police report or a restraining order, can I file a restraining order even though I am not a victim but am fearful of him? p.s. the male is a volunteer police officer.

State/Country relating to Question: California

Already Tried:
I am not directly involved & have not tried anything. However, I have seriously considered contacting the police department where the male coworker volunteers or works as a police officer. His actions have been a shock to all of us. It the whole "Ted Bundy" thought that, "he's a nice guy, he'd never hurt a fly" So what else has he done, what else will he do? Is he just a pervert and a stalker, or could he also be a child molester.....????

Hello,

My name is Eli and I am one of JustAnswer's attorneys. I'll be helping you resolve your matter today.

You CAN file a TRO (temp restraining order), but w/o testimony from the victims and/or their complaint, the TRO WILL fail. You need their cooperation to explain to the Judge why you feel you are in danger. Makes sense?

Best of luck in your matter. I'm here if you need any more clarification or follow up info.

I hope you found my answer helpful, and if so please click on the GREEN ACCEPT button for my answer. This is the only way for me to get credit for my work.

Your question will not close, and you will still have the opportunity to follow-up if and I would be happy to answer any and all of the follow up questions.

Remember, sometimes the law under which your situation falls does not give you the outcome or the choices you wanted - please understand that this is not the attorney's fault, but the way of circumstance.

There might be a delay between your follow up questions and my answers because I may be helping other clients or taking a break.
