I have finally gotten my divorce and settlement after 3 long years..my husband appealed until there was no appeals left...The last appeal was over in March...He of course has not paid the court odered alimony ect while he was appealing..Now he owes me over 40,000 dollars ..A QDRO is to be filed for my part of Ford Retirement too..My attorney has told me that QDRO was filed..And contempt charged were filed ect..I got supspious and inquired several times at the courthouse ..No filings are there and no court dates are set ..My attornet immeaditaly froze my exes Bank account for his fees that was awarded him..But I have not recieved my settlement..Is it time for a new attorney? I have questioned them and I have only recieved lies about filings..I have paid a great deal of money already to him and would like to have this over..Any suggestions?

Dear XXXXXXXXXXXX - If your attorney has failed to file the necessary paperwork involved in your case you should file a written complaint with the Bar Association. I have supplied their website below for your convenience. This would be considered neglect and is an ethical violation.

 

You need to get the contempt motions filed with the court and you should also be awarded attorney fees associated with the filing of the motion. If you actually lose any money due to your attorney's neglect you can file a suit for malpractice. If the court records show nothing has been filed it is rather obvious that your attorney has either lied or just has totally ignored your case and that is inexcusable.
