Question

I was a student of an online university. They dropped me from all my courses after three semesters, stating Financial Aid never paid for my first semester of courses. After a few phone calls I found out Financial Aid did not pay for any of the courses I had taken over the course of the three semesters! Immediately, the school demanded six thousand dollars. I was told to pay three thousand (out of pocket) with the promise of re-enrolling me into the school. Then after my good faith payment, I could resume courses and then they would roll the additional three thousand into the new Financial Aid plan they had worked out. I was unable to pay them the three thousand so now I am on the hook for the entire amount. The only defense I have is I wrote down the dates and times I talked to the Financial Aid office and who I spoke to. I hope someone can help me. Thanks, S

Answer

You would need a written letter or other documentation confirming the financial aid award to be able to contest the balance for payments. You could alternativelt seek to subpoena their record which may confirm such conversations and awards.

I am not certain if there is any record of the Financial Aid going to the school. I know when I signed up they said they were working on the lenders to have the money transferred to the school. Sallie Mae (the lender) authorized the amount of seventy five hundred dollars which I was told would not apply toward any of the previous semesters. These funds were requested while I was taking three semesters worth of course work. Also, Do I need a lawyer to have the school subpoenaed?

You would need a lawyer and a lawsuit to be able to subpoena. Indeed, without something in writing it is a very difficult case and be careful before spending money on legal fees if a lawyer is not offering reasonable assurance of being able to negotiate at least a reduction larger than the fee.
