Question

I was a beneficiary upon my Brother's death. I am receiving monthly monies from his Ohio Deferred Compensation plan, which taxes are being taken out monthly. I also received money from the estate amounting to $109,875. His estate was well under $600,000. The Lawyer involved sent me a Schedule K-1 (1041) for that amount. The estate is well under $600,000 and I have been told i will not be taxed on this $109,876. Is that correct??

My brother resided in the state of Ohio, which I have already received notification from the state that there is no state inheritance tax. I am a resident of South Caroilina, where I file state and Federal taxes. I am worried about the implication of Federal taxes!!

Thank you for the additional information.

Your attorney is correct that you will owe no inheritance tax on the money you received from your brother's estate. There is no inheritance tax at the federal level. Instead, the IRS imposes an estate tax on estates which exceed a certain value, but your brother's estate was far below the value where estate tax would be imposed.

There are some states which still impose their own estate tax or inheritance tax, which is why I asked the states you live in. Ohio does have an inheritance tax, but it only applies to estates worth more $338,333. SC does not impose any inheritance tax at all.

So you are not libable for any federal or state inheritance taxes on this money that you received.
