Question

Corporation is going to file taxes for their employees for 3d quarter 2009. (didn't send payment yet.) One of W2 employees, on the moment of getting salary in September 2009, was single. Got a big amount on his account from a company as a compensation for his work he ws doing during several months. In october he is getting merried. The corporation is going to file taxes for him. The question is - when filing W4, can he fill himself as married, has dependant and files together, and use tax advantages of it? The key issue is that he was getting $ in 3d quarter. And corp should pay taxes for him for 3d quarter when he was not merried. But in the moment of filing W4, he IS merried. And wants to be filed with wife. Cn it be done or not? The transnsfer to fed was done, to state - not, and neither was explained (no forms were filled/sent to the moment). If you now the answer? could you also refer to source of information you base your answer on?

He can provide a Form W-4 with his status as married. Corporation is not required to verify the Form W-4. Also, he is currently married when providing Form W-4.

Regarding payroll taxes- did the Corp already deduct payroll tax for Sept and issue him a paycheck?

Ok, great. That's what I wanted to hear.
The Corp deducted payrol tax before paying him.

Accepted Answer

If the Corporate deducted payroll tax before paying him than the Corporate is required to pay such taxed to the IRS. If the Corporate has refunded the excess tax amount deducted(based on the updated W-4 since the Corporate has not yet filed the quarterly tax return or paid the taxes) than the Corporate can deposit the tax based on the correct amount deducted. Normally Corporation should make deposits of tax actually deducted.
