Question

I am a widow with 5 living grown children. I had a will made out 13 years ago, since then 1 son had died. I still have a son at home with me . I have had a quit claim deed made out for him to own this house when I pass. does the Quit claim deed overide the will? I do not want to have new will made out. My only asset is this house. please let me know. thanks you, F. M.Lyman

Optional Information

State/Country relating to Question: Illinois

Accepted Answer

the quit claim deed will overcome a will, however, A quitclaim deed neither warrants nor professes that the grantor's claim is valid, so since you put his name on the deed, that will automatically become your sons when you pass without going to court to probate a will.
