I have a 2006 chevy malibu and my break lights stay on while driving if i tap the breaks lightly they go off for a few seconds and come back on i changed the stop lamp switch but that did not solve the problem.

yes if the key is off

Okay. THis is a common connection problem at the vehicles body control module. This can typically be fixed by removing the connections and coating them with dielectric grease and then reinstalling them. The module is on the passenger side as shown.
