Question

I broke up with my girlfriend. And we went and got a new car for her about two years ago. and put it in my name because her credt was bad. she made the payments. But she said because she was not on the papper work. That she is not legaly responsible for the pay off that we will be short on.But I am thinking because we traded her old car in that she was upside down on that car. that they carried over the balance of that old car to the new car price. will she have to come up with the rest of the balane. That I will be short from the trade in

OKAY i NEED TO TRUN IN THE CAR A DEALER SHIP WILL ONLY GIVE ME 12K FOR IT AND SHE OWS 18K ON THE balance / PAY OFF BUT SHE IS NOT ON THE LONE PAPPER WORK. BUT THEY CARRIED OVER HER UPSIDE DOWN BALANCE

YES i WANT HER TO PAY OFF THE BALANCE. SHE TOLD NE THAT BECAUSE THAT SHE WAS NEVER ON THE LONE FOR THE NEW CAR THAT SHE WONT HAVE TO PAY THE UPSIDE DOWN BALANCE

Thanks. I hate to say it but you have to go with what's on the paper. If it's just your name on the paperwork, you owe the dealer. You can try to sue her in small claims court to get reimbursed but the judge will be grilling you hard on the paperwork issue.

I know that it may seem to be unfair or unjust but when it comes to property and money, the paper is what counts.

What if I go to the deler and have them give me the papper work that she was upside down by 5k on her old car. Then they added that upside down BALANCE to the new car price. And then take her to small claims court

Yes. You can use that to prove unjust enrichment.
