Question

I had an accident with my company Truck. Nobody involved nobody injured. Trailer and load fully intact. I was 4 weeks on suspention and terminate after these. My Tickett was reduced from careless operation to faulty equipment, a none moving violation. My ex co-driver and I believe my accident happen do to supersingles drives. We had 1 new Tire with 50,000 miles and 3 with apprx. 230,000 miles wear. Lines from sliding sideways over pavement viseable. it was raining. My load was 40,000 LB pushing me to a higher speed coming over an overpass with a imidiate not visuable akward curbe. My trailer fishetailed and pushed me sideways onto a muddy ditch like shoulder. My food bord had bulget up I had no control with my food paddles. My truck Jackknifed and I finally came to a stop. When getting out the Truck the steps and the Tank where under the Cap. The Cap had moved off the frame to the driverside. I believe there was something wrong with my equipment. How can I proof this? Please help me...Thank you. Sonja Dittman cell phone XXX-XXX-XXXX

I have called the Boddy shop to where the Truck was towed after the Insurance claims inspection, but they denied to talk to me. I wrote several statements about my Accident to my company, but they said it doesn't look good for me even befor the crash-committee had come together. I don't know where to ask.

To find out what happen with my job!

the ticket was reduced from the proccecuting attorney, I am fine with that. But my Company counts my accident as being preventable and it will be on my dac report as such I believe. For me to get hired by another company will be almost impossible.

I need to know if I can go against my termination.

 

I have ot had any income since the accident on 09-12-09

And does it say that you are an at-will employee or that your employment is at-will?

I don't know, but believe it is employment at-will.

I am most concerned about te cause of my accident.

I need to know how I can find out if the accident was caused by an equipment failure ?

Answer

If you are an at-will employee, then your employer does not need any reason to terminate your employment. Just like you could quit your job at any time, your employer could terminate you at any time and for any reason. It may seem to be unfair and unjust but that is the very nature of at-will employment: you serve "at the will of" your employer.

As for your DAC report and the cause of the accident, you can only go by what was on the police accident report. Nevertheless, you still plead to a charge involving faulty equipement.

I know all you are saying, that isn't the point.

 

I need to know where I can find out if my accident was due to an equipement failure and if so, which part of the Truck caused the accident. ie different Tires, loose bolds connecting the cab to the frame, or anything else.?

Because I believe this accident was not at my fault. So does my Co-Driver!

My ticket was handlet by my Interstate Trucker Legal Assistance at the Court in Lake Charles La. because I could not apeare in Court. This Legal Aide only handels Tickets.

I want to find out if I have a case against my Company and or Freightliner who is the manufacturer of the Truck.

 

 

 

This I need an answer too.
