Question

My Husband I are seperated. He is in the military at fort lewis army base. He is required by military law to pay me support while we are married and he is still in the Army. The military can't legally take the money from him. they can make his life miserable which they have done ( extra jobs, loss of advancement etc.) He has agreed to have the money garnished and sent to me but then last minute he changes his mind. The military says I need to get a court order for garnishment and then they can attatch his wages without him interfearing. I'm living with my parents now in maine. how do I go about getting a court order? Thank you

Calling local court, contacting legal department on fort lewis base. they said i have to go in person to speak with a lawyer. Not possible.

You would have to file a petition in the local court for an order of support and garnishment based upon your legal separation or you can file it as part of your petition for divorce. If you have already filed for a judicial separation, then you would file a motion in court for support and garnishment and once you obtain that order you forward it to the military and they will honor that court order. If you cannot afford an attorney, you can go to legal aid and also call the state bar and ask for the pro bono attorneys in your area for assistance.
