I have been sued for collections. I contacted a lawyer who filed a motion to dismiss that was late. The court ordered a default judgement and I am now having my wages garnsished despite being exempt under Florida law. My wages have been zero for 6 weeks now. My lawyer never sent and exemption. the plaintiff has now filed a motion to disburse funds. Today I went on my own to the courthouse and filed an exemption form and hearing request. Would you have an idea how long it would take for a hearing or for a decision to remove the garnishment? My funds are frozen and the hardship is tremendous. Lastly, what are other motions I can use? Should I make a motion to dismiss or ask for a jury trial? What would help vacate this? Thank you for your time and consideration, Armando Castillo XXXXX@XXXXXX.XXX

You can go to court and make a motion to vacate the default due to having a defense/lack of notice. Motion is usually granted.
