Is there such a law in California that cover the Dimished Value of vehicle if involved in an accident? What is 40 Cal.App.2d Supp.825 and Brown v Roland? Also where can I find information on the above and on West's Ann.Cal.Civ.Code 3333? Thank you

Brown v. Roland, 40 Cal. Just want to double check to make sure this ruling is true in California as I am being told it doesn't apply in California that it's a Georgia ruling.

Accepted Answer

The case law that I provided was decided in the Appellate Department, Superior Court of California, County of San Diego. The Statute provided is a California Code. It's not Georgia law. Keep in mind the the California Court in Brown v. Roland addressed a car that was driven from a dealership and not a private citizen, but the case itself doesn't focus on that factor as being a deciding factor.
