Brown v. Roland, 40 Cal. App. 2d Supp. 825: In such a case, where an automobile is susceptible of repair, the damages include the reasonable cost of repair, plus the actual depreciation due to the injuries; and where there is no dispute about the cost of the repairs, the court is entitled to consider evidence of the decrease in sales price below the list price of that class of car at the time of the injury, and such comparison forms a proper measure of the depreciation damage in the absence of other evidence on the subject. ----- To view CALIFORNIA CODES CIVIL CODE SECTION 3333, go to the following web page: http://www.aroundthecapitol.com/code/getcode.html?file=./civ/03001-04000/3333-3343.7

Just want to double check to make sure this ruling is true in California as I am being told it doesn't apply in California that it's a Georgia ruling.

The case law that I provided was decided in the Appellate Department, Superior Court of California, County of San Diego. The Statute provided is a California Code. It's not Georgia law. Keep in mind the the California Court in Brown v. Roland addressed a car that was driven from a dealership and not a private citizen, but the case itself doesn't focus on that factor as being a deciding factor.
