I found a new method to earn tons of money. The only problem is, I don't know if it is legal or not. Basically, you pose as a woman online and you get guys to verify their age with their credit card on an age verification website (affiliate landing page). The website has its TOS right in their face, and they should read it, but many guys dont read it. I have not started doing this yet because I am not sure if it legal or not. The thing is, you say that they will not charge you or it is just to verify your age etc, and I think they actually charge around $50 to the CC. But again, the TOS is right their before they sign up. So my question, is this credit card fraud and can I get in trouble for that?

Answer

Yes, it is fraud because you are using illicit means (you are pretending to be someone you are not) to mislead and send individuals to a location where they must pay to enter.

There are tons of people already doing this. Also, the people have the TOS right their before they sign up that says they will be charged. The afilliate network probably has a thousand affiliates working for them, all doing the same thing. Is this a matter that the FBI would look into soon? What kind of trouble can I get in by doing this? How can I do this legally?

Answer

You asked if it was legal--it is criminal. There are tons of people that sells drugs, as an example, and that still does not make it legal.

I am not an FBI employee so I cannot tell you if they are actively pursuing it, but since it is fraud that is being perpetuated online, they can, at some point decide to go after the Network and under it, all of the affiliates who are defrauding others online. If charged under RICO, you can be sentenced from 5-20 years in prison for an offense, although most likely your sentence will be no more than 2-3 years under current guidelines.

Sincerely,

XXXXXXX XXXXXXXXX XXXXXX, Esq.
