Question

My step mother did not adopt my sister or I . My dad passed away in sept. She had been married to him for about 30 years. They lived in colorado. Are we entitled to any of their assests?

Thank you for your question. I am sorry for your loss. I am presuming by your question that your father died without a will, also known as passing "intestate." Distribution in such cases is determined by statute. In such a case, since neither you or your sister are related to your step-mother, under Colorado's laws of intestate succession, she would receive $100,000 plus half of the estate; you and your sister would be entitled to the remainder.
