Answer

Thank you for using JustAnswer!

I am very sorry to learn of your situation. Unfortunately, because your injury occurred over 26 years ago, you have no recourse because of the statuate of limitations has long, long ago passed.

Additionally, because you already had one lawsuit, you are left with the outcome of that result -- no matter how injust you believe it to be. There is no such thing as a second bite of the apple.

Good luck and best wishes for better days ahead. I hope that you find this information to be helfpul and this answer to be ACCEPTable!

So even through it seems like the case was sold - and I now i am suffering - with these seizures and they have started to affect my working - and the hospital says it's from the accident - there's nothing what so ever I can do - to go after either party? this is new issues coming from that same accident - the case never went to court - this attorney has allot of power here - still the time limit still apply?? I am sorry I am asking so much - it's just I am really having a hard time...

Answer

If the case was settled, as you suggest, then all claims were settled . Yes, there is still a time limit problem.

it never went to court - they did the depo and everything else - never got anything from them - I never went to court - they attorneys just held on to the case - it never went in front of a judge - does that make a difference?

Accepted Answer

No, it doesn't make a difference. Not every court case ends up in the courtroom. Even if no lawsuit was ever filed, it's too late to file one now. The statute of limitations has passed a long time ago.
