Question

I made $98,037 (total wages) combined with my wife in 2007. Each one of us had two employees. I paid $3,958 social security tax and my wife paid $2,403 (combined of $6,361 - which is larger than 2007 maximum limit of $6,045). I received a letter from IRS disallowing the excess Social security tax withheld, which I had on line 67 on my 1040 (for 2007 returns). Should I fight or are they right? According to their letter it says that each one of us must have $6,045.
