Question

My boyfriend's SS statement says that he doesn't qualify for Disability Benefits due to not enough quarters in the right time period. Some questions -- 1. should he apply for Disability Benefits anyway and then appeal ? 2. Should he apply for SSI benifits when he owns 5 acres of woods in Amite, LA and they say that counts as an asset ? He is not living there - lives in Violet, LA with me in my home. 3. How to best transfer that property to me ( like for debts owed ) so he can collect the SSI now and not have to wait 3 years ? Thanks, Marlene XXXXX@XXXXXX.XXX

nothing - have an appointment to apply for Disability next week. I think it best not to apply for SSI at that time.....

Thanks for asking Just Answer: If he does not qualify for SSD for insufficient work quarters there is very little you can do other than if a past employer failed to correctly report his work and you can prove this. Insufficient work quarters is a hard and fast rule and based on exact work history reported by employers. Unlike a disability determination there is no grey area. As for SSI: If he were to give you the property to pay you back for past debts then this would have to be documented completely. If you are going to try and get him qualified for SSI, it is possible to do something with this property and for him to qualify. He needs to see an Elder Law attorney to help with the transfer and documentation to make sure you get it right.
