Question

health insurance coverage - dependent coverage between age 19 and 25 Currently have retirement coverage for myself and family. Verizon goes by Federal Mandidated Law and contracted with Atnea Insurance for our coverage. Atnea will only allow coverage of our 22 year old IF he is a full time student or will cover if he is disabled and living at home full time. Washington State Health Care law states insurance conpanies must allow coverage for dependents to age 25, they do not have to be full time students. How can Atena deny our son coverage now that he is not in school.

If they are writing insurance policies in WA state they must abide by WA state law, if the policy was written in another state then they have to comply with the laws of that state. You are going to need to contact the WA insurance commissioner and your next recourse would be to file suit against them for violating the WA state laws.

not sure I want to take on Verizon Communications. They are world wide. How is it they can contract with Atena who doesn't offer individual policies in some states, but does offer coverage in all states through corporate contracts i.e. Verizon. I've had the Verizon Retiree Medical Plan :Atena for 7 months and so far all has been covered. Very confusing when I have people telling me Atena HAS to cover a dependent who isn't living with you nor is a full time student between age 19 and 25 because of Wash State Health Law. And Verizon Benefits manager states they abide by Federally Mandated Law not State Law. Aaahhh very confusing.

Answer

Verizon isn't infallable and they have lost some high profile cases lately. But that aside, when an insurer is authorized to write policies in a state, they are bound to abide by the rules of that state, so at the very least you would make your complaint to the state insurance commissioner. This is why people are telling you they have to cover, yes Verizon follows federal law, but if their plan is authorized and written in the state of WA, they also have to follow the law of the state.
