Question

My son had his face bashed in and 2 ten hour operations with 12 plates, 80 screws, 600 stitches and jaws wired shut(eating with a straw for 90 days) is due to get out in 3 weeks and NEEDS a Fedreal court Lawyer to file a case against Calif and housing, food , transportation to the hospital that needs to see him for 90 days and may never be able to work again. How do I find this type of person (ACLU is to busy as usual). - jrbutcher5 @ yahoo . com -

The ACLU normally does not handle personal injury lawsuits or other types of claims such as Section 1983 actions.

In order to find an attorney who would be willing to take the case, you will need to contact personal injury attorneys in your region. My son has used an Atty in the past and he told me to find some one that could file against the state (he can not). My son owns nothing and has no money, but will never be able to work again due to what happened in prison, I live in Ohio and am retired and widowed. When he gets out in 3 weeks the state plans on doing nothing and he will still be eating with a straw and has no transportation to the doctors, no housing, food or family in Calif. Along with legal help are there any state or federal services that can help?

In looking for an attorney, you may want to contact the State Bar of California Lawyer Referral Service.

Your son may want to apply for Social Security Disability.

He may want to apply for food stamps and Section 8 housing. One good place to begin would be to check the local county welfare department list for the state of California.

He should also ask the hospital if there is a social worker on staff. Many, many hospitals have social workers on staff who can put the patient in touch with local services which can help them upon discharge.

Thank you , we are working on the S S Disability and county welfare depts and the "Lawyer Referral Services" are all to busy unless someone in their world sends a client so they always use some way out. Is there a majic key word or words that may help or some one that will recommend my son. He is in Calipatria State prison, CA near San Diego.

OK, I like what you are saying, please give me more on this section 1983. For business reasons many years ago I took a paralegal course so I should be able to understand what you say. I think this will give me a good start so I'm very thankful.

Section 1983 actions can be used where, for example, a prisoner is denied his basic rights by the prison. This may be in the form of not giving him appropriate, necessary medical care.
