Question

We are having construction done on our house and the contract states that there is (possible replacement for countertop) and (maybe painting kitchen cabinets) and now the contractor is saying that he did not include a the island countertops and that will be an additional cost to us and did not include the labor his contract was only to cover the paint. Can he charge us extra for these things? His contract states that all of the work will be done for a set price and not itemized.

Hi XXXXXX;

If the contract stated that the job will be "completed" for the amount bid with no clauses of it excluding any part in particular then he is bound to do the job "completly".

Basicly if it is included in the plans that he gave you the bid for then he best be putting it in.

"possible replacement for countertop". This has nothing to do with a "New" island top. If he built a new island he owes you a top to go with it.

"maybe painting kitchen cabinets" Again nothing to do with a island counter top.

If it is not specificly excluded or otherwise modified in the contract then it is presumed included in the total bid to complete the project.

Mind you this is based on my knowlege of California contracting regulations. Your state may differ.
