Question

Since when is it okay for a Personal Injury lawyer to write a letter(without knowing all the true facts) on his employees (paralegal) word that my child support is not being dealt with in a timely manner? This said employee (paralegal) called my employer asking information stating her name and who she was representing. These 2 said individuals are my ex-husband and his current wife. This occurence has happened on 3 seperate occasions. My employers payroll departments are out of state and every time I have filled out the proper paperwork for the wage assignment.

Thank you for contacting our JA team for guidance. We are happy to assist you. However, we need a bit more information to more fully answer your question.

Please clarify. The attorney and paralegal are your ex husband and his current wife and are attempting to obtain information from your employer? What type of information?

NOTE: Sometimes we receive your question before we receive your additional "optional information". If my response does not appear to consider your optional information, please let me know as I was probably not able to view it when your question was first received.

How much the wage assignment is and when they can expect the child support so that they can get it expidited faster through child support recovery here in Ia. REasoning was that it takes to long when it is out of state. When the case worker for child support found out that she had called, the case worker was upset.

The attorney is not my ex-husband he is who my ex-husbands current wife works for and has never practiced family law.
My ex-husband always lets her do things like this when it involves our son.

Accepted Answer

I apologize for the delay. I was unable to log on for a few minutes.

Since they are not involved in the garnishment which is being processed through a state agency, they are not entitled to obtain information from your employer. I would report the attorney to the state bar association who can discipline the attorney for engaging in such conduct. It is the last thing attorneys want to happen, so it should get their attention and prevent future contacts with your employer.

Please let me know if you need additional information.

Best regards to you,

TG
