Question

My mother in law died she lived in Indiana and had all her properties and stocks etc. are owned in her Trust. Question. Does her family need to retain a lawyer to close out the distribution etc.? If so what kind of fee will a lawyer require?

Then you need to take the will to the nearest probate court to where she lived and "probate" the will -- the court will administer the estate and appoint the executor of the will according to her wishes. that executor will be in charge of distributing items pursuant to the will and making sure that the trusts are administered appropriately and go to the appropriate named beneficiaries. If most of the property is tied up in the trusts and the beneficiaries are already known, then an attorney will probably not be that expensive (you need one to get the matter into court and get the process going). If things get complicated -- that is when an attorney becomes expensive. If the process turns out to be simple, then it will probably be about $1,000 or so for the attorney's help. THe bill increases from there if anyone contests the will or the trust, etc. and things become more complicated for the attorney representing the estate. The attorney fees, however, are usually paidout of the estate and not out of the pockets of any of the heirs or beneficiaries. GOOD LUCK.
