Question

I am the Administrator of my daughter's estate in Maryland. I have to file her 2008 taxes. I just recently received a copy of her mortgage/tax form (1098). I prepared her taxes only to learn that her domestic partner says she has filed for the interest and the taxes though my daughter has filed for them in previous years. Her partner says she paid the taxes. Can she just do that without clearing that with the estate (me)? Now, I do not know if I should mail them, or seek another extension until the matter is solved.

Hello and thank you for using Just Answer. Does your daughter's domestic partner own part of the home?

She was put on the house and the mortgage several years ago by right of suvivorship. The mortgage 1098 had my daughter's SS# and she has always claimed the interest and the taxes. My daughter died in Feb. 2009, and the partner did not become the single owner until 2/09.

Her answer to me was that it was her turn. But, she never had a turn during the other years.

Accepted Answer

If she was put on the mortgage several years ago by right of survivorship and she paid the interest, she is entitles to claim the interest on her tax return.

Since your daughter's estate did not paid the interest in 2009 no deduction can be claim on the estate tax return.
