Question

Summary: A leak was discovered in April 2009 in the unit below mine. The HOA sent a construction company to come repair the leak. They ended up removing the entire wall of my living room, exposing me to the elements. They put a thin sheet of plastic over it and have not returned to seal it back up. They have done work on the outside of the unit, but nothing on the inside since April. The HOA is now in litigation with the contractor's who fixed the siding of all the units. However, I am stuck basically without a wall and living in horrible conditions. What can I do?

Thank you very much for your question.

First of all, this is not a contingency case as you are asking for damages based more from breach of contract than actual injury to you, so I can understand why your attorney did not wish to take this case.

Second of all, you have a couple of options:

1. You can contact your own insurer and see if they are willing to help redo this damage and then file for reimbursement against the HOA and the Builder.

2. You can sue the builder separately for the damage and breach of contract. Be aware that you may have difficulty collecting if the builder decides to go into bankruptcy.

3. You can sue the neighbor's insurance for the damages that her leak caused to you, and argue that any and all damages were caused directly by her, including the wall.

4. You can consider filing against the HOA for negligence in hiring a company that was so incompetent and left you worse off then you were.

It turns out the contractor they hired was not licensed and every unit in my complex now has the same issue. But I AM the only unit with an open wall.... I have incurred a lot of costs since this has occurred. My family came to visit and had to stay in a hotel for 21 days, I haven't been able to cook, can't purchase produce due to instant mold, flies..etc. My wood floor is damaged from the water leak testing....all and all it's over 50k in damages...

I am truly sympathetic to what you must be going through--it is completely unacceptable living in your own home that is open to the elements. However without filing against the guilty parties you will not be able to be compensated. Other then filing against the parties as I outlined for you, I am not sure what other advice or information I can prove you with, unless you want to try to file against the builders "pro se", that is without representation, and that is something I highly recommend you do not do.

Oh, my apologies.

This is what your attorney, at a minimum, must be competent in:
1. Plaintiff civil litigation
2. Contract law
3. Torts
4. Insurance law


Typically a personal injury attorney may not be sufficient, as there really is a mix of parties here to possibly bring on for the suit. You may also want to find an attorney who has experience with multiple parties on suits (typically called complex civil litigation) but that is an option.

I suggest two places to go and do your research for a competent attorney:
1. Contact the California Bar Association and ask for their referral section.

2. Go to www.avvo.com where you can do searches for attorneys based on specialization, location, fees, and even read past client testimonials.
