Accepted Answer

You do. As an heir of the estate, you will be entitled to an equal share in whatever property there is, however minimal. There might or might not be a reason for a probate (this is something you should address with your local probate attorney) but in this type of situation sometimes a probate becomes necessary so you can enforce your rights to certain property -- like the family photos. You should speak with a probate attorney right away.
