Question

I was convicted of 2 felonies in 1991 in Idaho, I have not been in any trouble other than 3 traffic tickets since. what steps do I need to take to get the felonies off my record/

I plead guilty to aggravated assault and conspiracy to delivery. I served 4yrs in prison and completed 1yr on parole. I did receive my gold seal for both felonies. I was 20 at the time.

Unfortunately, having records of adult convictions sealed or expunged is very difficult. Records of arrest, juvenile convictions, and certain limited sex offender convictions are covered for expungement by Idaho statute but, unfortunately, convictions for assault and conspiracy likely don't qualify for that type of expungement.

For records of your criminal convictions to be sealed, you have to petition a state court judge to seal or "expunge" the record, so that the public, including, for example, potential employers, do not have access to this information. However, unless state statute specifically provides for expungement, it is up to the judge whether or not to seal or remove a criminal conviction, and it is very unlikely, despite how long ago the convictions were. That is not to say you shouldn't try, but you should know the odds going in.

A petition for expungement can be gotten from the clerk of court's office from the state courthouse nearest you. However, to increase the odds of your success, you are going to need to seek the assistance of an attorney who has experience in expungement. For a referral to an attorney in your area of Idaho, you should contact the Idaho State Bar Association HERE.
