Answer

Thanks for your question. She can enter as private pay here and then they will allow her to spend down and go on medicaid. This is realistically her only option. You may be able to spend down on prepaid funeral including plot/marker and also pay any medical bills she has outstanding here.

But she would be eligible here after spend down. That covers resources. If her income is too much see about here resending her pension here. Many plans allow folks to reduce for eligibilty here.Contact the plan and ask.

Your ME--medicaid eleigibiltiy worker can guide you in the process and give you the limits to shoot for here. You need to be real careful here and not sign any financial guarantees or any kind with nursing home.Make sure only she is liable here for her care.

To me if you will contact the NE worker here and get good information about where exactly she is high you can do the spend down.Resources are real easy--you just ask for a list of things you can spend it on to make her eligible.

The pension here if it too much is harder to get reduced. But a lawyer here can't really help you that much. She is past the age where say she could stash something in trust like the cash..But really the ME worker would give you limits on funeral planning. And I deal in elder law alot.

I will tell you that statistically she won't be in the nursing home all that long .90% of nursing home patients live there 5 years or less.By the time they truly qualify here they have enough medical problems they don't live that much longer.

Good luck here resolving.I know that dealing with them like this can be so hard and painful for you. I have had some experience myself. It can take a toll on your health too so take care of yourself as well.
