Question

I got a mechanic 2 do some work on my car.He led me 2 believe he was the owner of his own shop.He DROVE my car from my house 2 the shop. I gave him $1100 for the parts.The work was to be done in a week.He gave me the run around for a month & after I got fed up w/ him I went 2 the shop only find out that he was not the owner of the shop he only leased out a space at the shop & that he owned the shop owner money.I told him to return my money & give me back my car in the same condition I gave it 2 him. He has only returned $600 & has left my car a total wreck.I told the shop owner that I was just going 2 tow my car away & he has refused to give me back my car.But I have never made a deal w/ the shop owner I didn't even know who he was until a week ago.He wants $250 from me or the mechanic b/c he is owned so much money from him. I called the police 2 try and obtain my property and they said its a civil dispute.Who do I sue? And for how much? What do I sue for?

No written contract but I have reciepts for the money I gave the mechanic and the reciepts state what he was to do. Total damages right now is the money still owed to me and my car now is in worse condition than I gave it to him, it needs a whole new engine and who knows what else. Also the owner of the shop wants 250 to get my car out of there. Total now is around 3750.

Answer

You should sue the company for your damages in small claims court after making written demand. The person you dealt with is a mere employee and agent of the employer company which is liable and also more likely to have money to pay this off.
