Question

My mother hired a contractor to paint her house.The contract stated 1/2 of the price up front,1/4 due halfway through job,remainder due upon completion.The total was $15625.My mother paid $7500 at the beginning of the job.Now,The contractor is asking for the money that is due 1/2 way through.The problems are,we are not satisfyied with how the house looks.In places of the house he is saying are finished.The paint is uneven and has ridges where they have scraped.it is not a smooth finish.There are places where the paint is discolored it looks splotchy.In other spots there are goudges in the wood where they had tried to scrape the paint.I told him before we sent any money we would like to meet with him and discuss problems that we see with what they have done.He refuses to meet or discuss problems with the house until he gets a check.He has changed the amount of what should be due for the 1/2 way point 3 times.He's now threatening to put lien on the house if he doesn't get a check tomorro

Hello,

 

If she has a written contract that states the terms of payment, that is what the painter is stuck with. That is a common payment setup and is normal in the industry. I would tell him that he gets nothing more until he meets with you to discuss your concerns and if he places a lien on your property, you will file a lawsuit against him for "slander of title". Slander of title is a common law tort impugning ownership of land that interferes with owner's ability to sell or borrow money on land, with resultant economic harm.

 

Additionally you will sue him for breach of contract and for breach of the implied warranty of workmanship. He is not entitled to any additional payment under the contract until he is halfway through and the job is of workmanlike quality.

Tell him you have contacted an attorney who has suggested you try and talk with him before you file suit and see if that gets him in a more reasonable mood.
