I just had my son about a week ago and once I came home from the hospital I was notified that I was going to be evicted. I was wondering if they are legally able to evict me even with a newborn baby in the apartment?

Unfortunately, having a newborn baby does not give you any legal arguments to fight the eviction. However, sometimes judges will be lenient. You should contest the eviction and get a hearing in front of the judge. You may not have a legal defense to the eviction and the judge will most likely grant it, but it may buy you some time.
