Question

Hi, We have rented a home in Orlando for 9 years. Monday we are served as tenant that the home is going to enter forclosure if they don't hear from the owner in 20 days. We had given the owner a 45 day notice becuase the homewe are having built will be done on 11/19. Yesterday the owner called and said that he is trying to short sale the house and we may have to move in a few days. Also that our security deposit may notbe returned , it is up to the attorney. Is this correct? What are my options? nancy Baca

Answer

A short sale takes months to complete and you will not have to move before November 19. He can't order you out, he has to go through a formal court eviction if he wants you out and that also takes time. He owes you your full security deposit back when you move out. The foreclosure and short sale have NOTHING to do with his PERSONAL obligation to repay your security deposit. You can sue him for it.

So the lawyer does not have anything to do with you getting the security deposit back.?

 

The house itself is in pretty bad shape. The ceiling has leaked, which he paid to fix, the carpet is worn , at least 9 years old, and the hurricane charlie took part of the screen door out during that storm and we had to replace the front door ourself because it was buckling becuase he had some one put a piece of board over the door. The walls in the family room have paneling over studs which has started to rot. can he how our deposit back from that? Would you clean it before you moved?
