WHEN BUYING AN OUT OF STATE ATV/OFF ROAD VEHICLE(FROM MISSISSIPPI)AND PAYING NO TAXES. WHAT DOES THE LAW STATE ABOUT PAYING TAXES WHEN RETURNIG THE ATV TO TEXAS. THE BIKE WILL NOT BE REGISTERED BUT A TITLE WILL BE BOUGHT ($33.00) AND A LOCAL CREDIT UNION WILL BE THE LIEN HOLDER. THE BIKE WILL NOT COME THROUGH A DEALERSHIP HERE. WOULD THE SALES TAXES LEGALLY HAVE TO BE PAID ON THIS PURCHASE BEING IT IS NOT GOING TO BE REGISTERED OR LISCENED TO DRIVE ON THE ROAD. GETTING ALL KINDS OF DIFFERENT ANSWERS FROM LOCAL DEALERS, CREDIT UNIONS AND COUNTY TAX OFFICES. THANKS!

JUST ASKING AROUND. ASKED CREDIT UNIONS, LOCAL DEALERS, AND INDIVIDUALS WHO HAVE BOUGHT OUT OF STATE OFF ROAD VEHICLES. DEALERS SAY I HAVE TO PAY, CREDIT UNIONS SAY NO BUT NOT SURE, COUNTY TAX OFFICE SAY NO IF ITS OFF ROAD USE ONLY.

This is a great question. People do this all the time. I know a lot of people who buy vehicles in Nevada and bring them in to California. The states have caught on to this trick.

But the county tax office in your area is right. If you are using it for off road purposes, you should not have to pay tax on the bike.

SINCE I EMAILED THIS QUESTION I HAVE SPOKEN TO THE STATE COMPTROLLER OFFICE HERE IN TEXAS AFTER A LOCAL DEALER TOLD ME THAT THE COUNTY ACCEPTS THE $33.00 TITLE FEE BUT THE SALES TAX GOES TO THE COMPTROLLER OFFICE. I DIDN'T ASK THE QUESTION, (VEHICLE CAN'T BE LISCENED TO DRIVE ON THE ROAD) TO THE COMPTROLLER OFFICE . STILL UNSURE OF THE THE CORRECT THING TO DO. I AM GOING TO ACCEPT THIS RESPONSE AND PAY THE FEE REGARDLESS OF YOUR NEXT RESPONSE , I JUST WANT TO MAKE SURE I DUE THE PROPER LEGAL THING AND NOT BE HIT WITH ANY TAXES OR PENALTYS DOWN THE ROAD. THE COMPTROLLER OFFICE SAID I HAVE TO PAY THE TAXES BUT THE QUESTION ABOUT IT NOT BEING STREET LEGAL WAS NOT BROUGHT UP.

Accepted Answer

The extra safe thing to do is to pay the tax and then ask for a refund. But I dont see any provision requiring you to pay the tax.
