Question

How can you save a loved one's home when they are probobly going to be living in a nursing home after a hospital stay? I am afraid that the state will take her home to pay for the nursing facility, since she has no other money or means bt which to pay.

Optional Information

State/Country relating to Question: North Carolina

Accepted Answer

Thank you for contacting our JA team for guidance.

You would need the assistance of a property law attorney with elder law abuse, but what needs to be done is a transfer of her property to the heirs she wishes to have the home, reserving a life estate for herself. This is often the best way to dispose of property while maintaining an interest that is virtually worthless when it comes to obtaining state assistance.

Please let me know if you need additional information.

Best regards to you,

TG
