Question

I sold an item on Ebay. The listing stated that item weighted approximately 300 lbs., that buyer was responsible for shipping, and that shipping cost may vary depending on destination and method of shipping. The buyer is not refusing to take deliver of item and demanding a full refund from Paypal. According to Paypal the buyer is entitled to her monies because she never took delivery. I believe the freight company is charging storage fees increasing the amount owed and I don't the funds to retrieve my property back. Chances are the item will be lost or sold. I have tried to reason with the buyer even offering to pay $100.00 of the shipping cost to resolve this matter. What are my options? I live in Florida and buyer lives in Indiana. If this becomes a legal matter for small claim court where would I have to file?

I have tried to explain to the buyer that the listing was clear and stated that shipping cost may vary. I attempted to resolve this matter by offering to pay $100.00 toward shipping cost to conclude transaction. I've suggested that the buyer seek legal counsel to understand the possible consequences of her decision. Plus I have forwarded Paypal a copy of the listing along with related emails between me and the buyer.

Hi Bigdaddy. This sounds like a nightmare. I hope I can offer shed some light. But I do have a question: has ebay closed its investigation or is the matter still pending with them?

Paypal is conducting an investigation into the matter. I attempted last night to file a complaint with Ebay, but it appears she filed a complaint with Ebay so I was unable to. Accoring to Paypal the amount of money I listed for shipping is all the buyer is required to pay. I informed Paypal what the listing stated and that Ebay shipping calulated is not equipped to estimate cost of frieght companies. When asked what should I do in the future I was told to overestimate the shipping cost. But then I stated that appears misleading to me for if its not the true shipping cost then the buyer would find themselves in the same situation I am in depending on my honesty to pay them any overage. Paypal had no answer for that. I am pretty sure this matter will have to go to small claim court but the question is where. I really would like to sue Paypal or Ebay for not being equipped to handle a siuation such as this.

Did ebay give the shipping a dollar value? Or was the information about weight and shipping to be determined later the only statement made?

Ebay has a shipping calulator. I attempted to utilize this feature but it could not determine shipping cost due to its limitations. I then place a zeto value in the shipping box, but that prompted the listing to be listed with free shipping. After some thought I placed a shipping value of $100.00. I then added to the listing in bold print that shipping cost may vary depending on destination and method of shipping. My listing also stated that it was 15X15 commercial grade bounce house that was for sale along with a blower. That item weighted approximately 300 ibs and suggested buyer use a trucking company. Frankly I don't know where I went wrong to make this matter as clear as possible. Both Paypal and the buyer are being unreasonable and I don't appreciate the fact that I am being accused of misleading the buyer.

I see the problem. As a practical matter, have you attempted to speak to a supervisor at Paypal about this? Sometimes the line personnel on the phone work with a limited set of powers. There may be a way to resolve this by getting to a supervisor and then a supervisor's supervisor, etc.

If not, if you wanted to go to small claims court, you could do so. But the conflicting information (the $100 shipping in one place and the actual shipping notice elsewhere could be used to argue against you). I realize the amount of money at stake is not enough money to make it worthwhile to hire a lawyer. So if you did go to small claims court, you would probably want to bring it to a court in the buyer's state, and home county. This is so because even if you won, you'd either have to find assets owned by the buyer lcoated in your in home state, or get a court in the buyer's state to honor your state court's ruling. Its administratively easier to collect when you win if the court is in the buyer's state. (Also, if they buyer is not resident in or does not do business in your state, if you sued in your state,he or she could try to remove the case to Federal Court where things could get more complicated for you, representing yourself.)

As for ebay and paypal, big ecommerce enterprises have extensive terms of service that function as a contract. You'd have to look closely to see if you are required to go to arbitration before going to court. Often, in arbitration, the loser pays the arbitration costs, which are likely to be higher than the amount at stake.

In sum, I'd first try to escalate the matter at ebay and paypal to higher authority inside each organization before going to small claims court. And remember the importance of documenting your contacts. Keep a log of whom you spoke with, the date and time. Also, putting things in certified letters can sometimes help show you are serious (remember to keep copies, and pay extra for a return receipt!)

For the future, I'd suggest selling such large things under terms clearly stating the buyer prepays all freight charges. At worst, you'd have to relist the item on ebay, if the buyer refused the freight charges-- but at least there'd be no shipping lien on your goods.
