Re first house tax credit. Closing on new home Nov 2009. Couple living in their own condo for years but have been non citizens. Recieved their (husband & wife) green cards March 2009. Would they be eligioble for first time home buyer credit for new home being purchased in Nov 2009?

Hello again XXXXXXX,

If you have been residents of this country for 5 years, then even though you may just now be receiving your green cards, you have been considered to be resident aliens. You are a resident alien as long as you have been present in this country for at least 31 days in the current year and a total of 183 days in the previous 3 years. As a resident alien, you are subject to the same tax rules as a US citizen.

That being the case, if you have already owned a condo that you used as your primary residence during the last 3 years, you would not now qualify for the first time home buyers credit.
